Terms and Conditions for Easy Property Clearances

Basis of Sale

These Terms and any quotation constitute the entire agreement between you and us for the provision of our rubbish collection services, overriding any other terms and conditions.

  • If we provide a quote without inspecting the location, a contract is formed upon your acceptance, whether via telephone, email, or other means. We reserve the right to adjust the quoted price if the information you initially provided is incomplete or inaccurate.

  • If an inspection is required before providing a quote, there will be no contract until we issue a final quotation. Any prior price indication is an estimate only and not binding.

  • Our quotations remain valid for 30 calendar days unless we withdraw them in writing before this period expires.

  • We will make every effort to locate and return specified items upon request. However, any unspecified items removed become the property of Easy Property Clearances.

Cancellations and Charges

  • You may amend or cancel a booked collection up to 24 hours before the scheduled collection time by providing written notice. Cancellations or amendments within 24 hours of the booking will incur a £60 administration fee.

  • If you are a consumer, you have the right to cancel a booking within seven working days of the contract’s formation, except:

    • If our services commence within this period with your consent.

    • To exercise the right to cancel, written notice must be provided.

  • If we are unable to remove any items due to access restrictions, we may attempt dismantling at our discretion.

  • The allocated clearance times are:

    • ¼ lorry load: 15 minutes

    • ½ lorry load: 30 minutes

    • Full lorry load: 1 hour (based on a 14 cubic yard storage lorry)

  • Additional fees may apply if clearance exceeds the allocated time, except for full property clearances.

Provision of Services

  • We will perform our services with reasonable care and skill, barring delays due to circumstances beyond our control.

  • We will make reasonable efforts to meet scheduled collection dates but may revise them due to unforeseen circumstances.

  • You must provide our team with safe and free access to the premises and disclose any special circumstances, including but not limited to:

    • Difficult-to-reach rubbish

    • Large or heavy items

    • Potential disputes over item removal

    • Parking restrictions

  • Failure to provide accurate information may result in cancellation or additional charges.

  • You confirm that you have full authority for us to remove and dispose of items. You agree to indemnify us against any third-party claims related to clearance authority.

  • If we suspect the presence of asbestos or hazardous materials, we may vacate the premises and will not be responsible for further collection. You will still be liable for payment.

  • If hazardous materials are later identified in items already loaded onto our vans, we may charge you for specialist removal services.

Pricing and Payment

  • Prices are as per our quotation and exclude VAT.

  • Invoices may be issued anytime after service completion and must be paid:

    • Within 24 hours if you do not have an account.

    • Within 30 days if you have an account.

  • Late payments will incur interest at 4% above Barclays Bank PLC’s base rate.

  • If payment is delayed, we may suspend further services until full payment is received.

  • You must make payments in full without deduction, withholding, or set-off, except as required by law.

Limitation of Liability

  • We do not exclude liability for death or personal injury caused by negligence, fraud, or any breach of obligations under applicable sales laws.

  • Except for the above, we are not liable for:

    • Loss of profit

    • Indirect or consequential loss

    • Any amount exceeding the price of our services under the contract

Events Outside Our Control

We are not responsible for delays or failures caused by events beyond our control, including but not limited to:

  • Civil unrest, war, terrorist acts

  • Natural disasters, extreme weather

  • Transport or communication network failures If such events occur, obligations under these Terms are suspended for the duration, and we will seek alternative solutions.

Termination

  • We may terminate the agreement with 24 hours’ notice.

  • Termination does not affect any outstanding rights or payments owed to us.

Assignment

  • You may not transfer your rights or obligations under these Terms without our prior written consent.

  • We may transfer our rights and obligations to another entity without affecting your rights under these Terms.

Notices

  • Notices will be deemed received:

    • 24 hours after sending via email

    • 3 days after postal dispatch

Data Protection

  • We will use your personal data only for service provision or to inform you about similar services unless you opt out.

  • We do not share your data with third parties unless required by law.

  • Your details may be shared with credit reference agencies for payment verification.

Photographs and Videos

  • We may take photographs or video footage as proof of clearance.

  • Content may be used for marketing/social media unless you opt out by emailing info@easypropertyclearances.co.uk.

Guarantee

  • If a person approving our quotation (the “Guarantor”) acts on behalf of a company, partnership, or other entity (the “Client”), the Guarantor personally guarantees payment if the Client fails to pay.

  • If legal barriers prevent recovery from the Client, the Guarantor assumes full liability.

General

  • If any provision in these Terms is deemed invalid, the remainder will still apply.

  • Our failure to enforce any term does not constitute a waiver of our rights.

  • Third parties have no rights under these Terms under the Contracts (Rights of Third Parties) Act 1999.

  • These Terms are governed by English law, and disputes shall be settled in English courts.

  • Please verify the accuracy of these Terms before committing. We are only responsible for written statements made by our authorised representatives.

  • Any promotional materials are for reference only and do not form part of the contract.

  • We reserve the right to amend these Terms from time to time. Changes will apply only to orders placed after amendments take effect unless required by law.
